PRIVACY AND COOKIES POLICY

This Privacy and Cookies Policy (“Policy”) explains how BRICS Entrepreneurship Alliance (BEA) India Association / BRICS Entrepreneurs Alliance India (“BEA India”, “BEA”, “we”, “us” or “our”) collects, uses, stores, shares and protects information received through its website, registration forms, membership processes, events, communications and other official digital channels.

This Policy applies to all visitors, applicants, members, company representatives, partners, donors, sponsors, collaborators, event participants and other persons who access BEA India’s website or share information with BEA India.

1. Responsible Entity

For the purposes of applicable data protection laws, BEA India shall act as the responsible entity/data fiduciary for determining the purposes and manner of processing personal data collected through its website, registration forms, membership processes, communications and other official channels.

2. Collection of Information

BEA India may collect information that users voluntarily provide through the website, registration forms, contact forms, emails, uploaded documents, payment confirmations, event forms or other official communications.

This may include:

  1. Name, designation, email address, phone number and contact details of the authorised representative;
  2. Company/organisation name, address, website, type of entity, year of incorporation and business profile;
  3. Industry, business activities, products/services, markets served, turnover, employee strength and areas of business interest;
  4. Membership, registration, event, sponsorship, donation, partnership or collaboration-related information;
  5. Statutory, tax and compliance-related details, including PAN/tax identification, GST details and declarations regarding statutory or regulatory compliance;
  6. Information relating to legal or regulatory proceedings, where voluntarily disclosed as part of the registration or verification process;
  7. Documents uploaded by users, including incorporation/registration documents, company profiles, brochures, PAN/tax documents, GST documents and other supporting documents;
  8. Payment-related information such as transaction ID, invoice details, receipt details or payment confirmation;
  9. Communications, queries, comments, requests or feedback shared with BEA India; and
  10. Basic technical information such as IP address, browser type, device information, operating system, date/time of access, pages visited and cookies or similar website usage data.

BEA India does not knowingly collect personal data from children. The website and BEA India’s services are intended for entrepreneurs, professionals, companies, organisations and adult users.

3. Purpose of Collection and Use

BEA India may collect and use information for the following purposes:

  1. To process membership, registration, event participation, sponsorship, donation or partnership requests;
  2. To verify applicants, members, company representatives, partners and stakeholders;
  3. To maintain BEA India’s records, member database and registry of companies or participants;
  4. To communicate with users regarding membership, registration, events, partnerships, collaborations, invoices, receipts or other official matters;
  5. To facilitate trade, investment, business partnerships, joint ventures, technology collaboration, market access, government/PSU engagement and BRICS+ cooperation;
  6. To assess eligibility, suitability, compliance and credibility of applicants or participants;
  7. To issue invoices, receipts, acknowledgements and other official communications;
  8. To respond to inquiries, complaints, grievances or requests;
  9. To comply with applicable legal, regulatory, tax, accounting, audit or reporting requirements;
  10. To protect the rights, reputation, security and legitimate institutional interests of BEA India, its members and stakeholders;
  11. To prevent fraud, misuse, unauthorised representation, misrepresentation or unlawful activity;
  12. To improve the website, user experience, administrative processes and digital security; and
  13. For any other purpose for which the information is voluntarily provided or lawfully processed.

4. Basis of Processing

  • BEA India processes personal data on the basis of consent, voluntary submission of information, lawful purposes connected with BEA India’s activities, compliance with applicable legal obligations, and such other grounds as may be permitted under applicable law.
  • By submitting information through the website, registration forms, uploaded documents, email or any other official channel, the user confirms that the information has been voluntarily provided and may be processed by BEA India for the purposes set out in this Policy.
  • Where processing is based on consent, the user may withdraw such consent by writing to BEA India. However, withdrawal of consent may affect BEA India’s ability to process membership, registration, participation, collaboration or other requests. Withdrawal of consent shall not affect processing already carried out before such withdrawal or any processing required under applicable law.

5. Sharing of Information

  1. BEA India may share information, where necessary and appropriate, with:
    1. Authorised office-bearers, employees, consultants, advisors, representatives and personnel of BEA India;
    2. Participating national entities, institutional partners, event partners, government bodies, trade bodies, industry associations, chambers, financial institutions, business counterparts or other stakeholders connected with BEA India’s activities;
    3. Banks, payment service providers, auditors, accountants, tax consultants, legal advisors and professional service providers;
    4. Website hosting providers, IT service providers, cloud storage providers, email service providers, form management tools and other technology vendors;
    5. Legal, regulatory, governmental, judicial or law enforcement authorities, where required under applicable law; and
    6. Any person or entity where disclosure is necessary to protect BEA India’s rights, reputation, security, members, stakeholders or platform.
  2. BEA India does not sell personal data to third parties.

6. International Sharing

BEA India’s activities involve cross-border cooperation and engagement with entrepreneurs, institutions, companies, partners and stakeholders across BRICS+ and other relevant jurisdictions. Accordingly, information may be shared outside India where necessary for membership, verification, collaboration, business facilitation, event participation, international cooperation or related purposes.

BEA India shall take reasonable steps to ensure that such sharing is carried out for lawful purposes and subject to appropriate confidentiality, access control and data protection safeguards, and in accordance with any restriction or requirement applicable under Indian law.

7. Data Security

BEA India shall take reasonable technical, organisational and administrative measures to protect personal data against unauthorised access, misuse, disclosure, alteration, loss or destruction. However, no website, online platform, email system or digital transmission can be guaranteed to be completely secure. Users are therefore advised to exercise caution while sharing information online and to avoid submitting unnecessary sensitive information.

8. Personal Data Breach

In the event of any personal data breach, unauthorised access, accidental disclosure, loss, misuse or compromise of personal data, BEA India shall take reasonable steps to assess the nature and impact of such incident and undertake such remedial, reporting and notification measures as may be required under applicable law.

BEA India may notify affected users, relevant authorities, service providers or other concerned persons where such notification is required or considered necessary for protecting the interests of users, BEA India, its members or stakeholders.

9. Data Retention

BEA India shall retain personal data only for as long as necessary for the purposes for which it was collected, including membership administration, registration processing, verification, stakeholder engagement, legal compliance, accounting, audit, dispute resolution, fraud prevention and protection of BEA India’s rights and institutional interests. Where the information is no longer required, BEA India may delete, anonymise, archive or securely store it in accordance with applicable law and internal requirements.

10. User Rights

Subject to applicable law, users may request:

    1. Access to information regarding their personal data processed by BEA India;
    2. Correction, completion or updating of inaccurate or incomplete personal data;
    3. Deletion or erasure of personal data, where legally permissible;
    4. Withdrawal of consent, where processing is based on consent;
    5. Grievance redressal in relation to processing of personal data; and
    6. Nomination of another individual to exercise rights in the event of death or incapacity, where applicable under law.
  1. BEA India may require verification of identity before processing any request. BEA India may decline or restrict a request where retention or processing is required for legal compliance, contractual obligations, accounting, audit, dispute resolution, fraud prevention, regulatory purposes or protection of BEA India’s rights and legitimate institutional interests.
  2. BEA India shall make reasonable efforts to respond to privacy-related requests and grievances within the timelines prescribed under applicable law.

11. Accuracy of Information

Users, applicants, members and company representatives are responsible for ensuring that all information submitted to BEA India is true, accurate, complete and updated.

BEA India shall not be responsible for any consequence arising from false, inaccurate, incomplete, misleading or outdated information submitted by any user, applicant, member, company representative or third party.

12. Third-Party Websites and Links

The BEA India website may contain links to third-party websites, social media pages, payment interfaces, event platforms, partner websites or external resources. BEA India is not responsible for the privacy practices, security, content or policies of such third-party websites or platforms.

Users are advised to review the privacy policies of such third parties before submitting any information to them.

13. Payments and Financial Information

Payments relating to BEA India membership, registration, sponsorship, donation, participation or any other official activity should be made only through officially notified BEA India bank accounts, payment links, invoices or authorised channels. BEA India does not ask users to share card passwords, OTPs, PINs or sensitive banking credentials. BEA India shall not be responsible for payments made to unauthorised persons, personal accounts or third parties falsely claiming association with BEA India.

14. Cookies and Similar Technologies

BEA India’s website may use cookies and similar technologies for website functionality, security, form submission, navigation, user experience, analytics, performance improvement and website administration.
